1. Agreement & Specifications
When you engage FiveHues.com (“we”, “us”, “our”) for any service, the process begins with your intake of specifications. This includes submitting all necessary branding materials, content, colors, functionality requirements, file formats, imagery, copy, and any other information required to fulfill the project.
Within this process we will prepare a Project Checklist:

A list of everything you must provide (imag​es, logos, text, Aetc.).
A clear statement of what we plan to deliver (services, number of designs, platforms, timelines).

After we receive all required materials, we begin work.

2. Timeline

For custom design projects, the design process takes 3 business days once all required information has been submitted.
You will have access to our iPort CRM system throughout—this allows you to monitor progress, see deliverables as they develop, and communicate feedback until completion.

3. Revisions & Deliverables
We offer up to 5 rounds of revisions per project. For the duration of revisions:

All revised documents remain watermarked until a round of revisions is accepted as final.
Only after your acceptance will the final, watermark-free deliverables be issued.

Deliverables will vary depending on the service selected, for example:
Website Design
2 custom moodboard concepts
1 full site design concept (based on moodboard feedback)
Templates & interface code for homepage, interior pages, headers, paragraphs, images, videos, links, forms, etc.
Cross-browser testing (Chrome, Firefox, Safari, Edge)

Mobile / Tablet Design
A separate concept for mobile/tablet
Fully responsive design implementation

4. Refund Policy & Ownership
No refunds will be issued once work has formally begun (i.e. after you have submitted all required materials and the project checklist is approved). Instead, you are entitled to revisions (up to the 5 rounds described above).
Revised documents are not to be used or published unless you have formally accepted them by signing off on the deliverables. Any use of revised materials before acceptance will be considered a breach of contract.
In the event of such misuse, we reserve the right to seek legal and financial remedies, including damages for unauthorized use.

5. Acceptance & Final Deliverables

Once you accept a round of deliverables in writing (email or via CRM), they are deemed final.
At that point we will provide you with the final, watermark-free files.
Ownership of the final deliverables transfers to you upon full payment.

6. Termination & Breach
If you fail to supply required materials after the initial request / checklist within 15 business days, or fail to provide feedback during revision rounds, FiveHues.com reserves the right to pause work. If the delay continues beyond 30 business days, we may terminate the project, retain payment for work completed to date, and you will receive any finished files up to that point.

Use of unaccepted, unreleased, or watermarked materials constitutes a breach, and we may take legal action for damages.

7. Pricing & Payment Terms
We require a deposit of 50% of the project fee before starting work.
The remaining 50% is due upon completion, before final deliverables are released.

All payments are non-refundable once work starts. Payment methods accepted via our billing portal or invoice as specified.

8. Intellectual Property Rights
We retain copyright and ownership of all preliminary and revised materials until full payment and written acceptance of final deliverables.
After those conditions are met, you are granted full rights to the final, accepted deliverables for your intended uses.

9. Limitations of Liability
We are not responsible for delays caused by you failing to supply requirements or feedback.
Except where prohibited by law, our liability shall not exceed the total amount you paid for the specific service in question.

10. Contact & Dispute Resolution
If you have any concerns or disputes, please contact us in writing. We aim to resolve disagreements amicably. Should legal action become necessary, this agreement shall be governed by the laws of the state in which FiveHues.com is registered.

These terms ensure clarity, protect both parties, and set expectations for delivery and quality. Please review carefully before commissioning any work.​
